Reporting:
Realtime
Reporting is the ability of the court reporter to use a computer-assisted
stenograph machine which allows the testimony of the witness to appear on a computer
monitor in plain English text within a matter of seconds from the time the words are
spoken.
This is
accomplished by the matching of the reporter's stenographic keystrokes with the same stroking already
stored in the reporter's computer dictionary and associated with a specific English word.
If a match occurs, the English word appears on the monitor.
If a match does
not occur, an "untranslate" appears on the screen in the
form of either a phonetic spelling of the word or the court reporter's stenographic
keystrokes which, of course, are unreadable to the untrained eye, but which can later be
corrected by the court reporter. Ordinarily untranslates occur when new words are
presented to the court reporter which are not already in his computer dictionary.
Court reporters
who write realtime are highly skilled members of their profession in that they are required
to differentiate or discriminate among all homonyms such as to, two, too, II and 2 so that
they will translate into their appropriate forms.
Reporters lessen
the occurrence of untranslates by obtaining from counsel in advance a list of the names of witnesses,
geographic locations and new technical terms which are expected to be used in the
testimony so that these new words can be entered into the reporter's dictionary. The
English text can then be sent via cable to the attorney's computer where it is
"captured" by the attorney's realtime software.

Assisting
the Interpreter:
In many proceedings, simultaneous translation is required in order to permit non-English
speaking parties to understand all that is taking place during the proceedings. While
certified interpreters must, and do, rely upon what is said by the participants as the
source of their translation, they nonetheless find it helpful to be able to refer to the
realtime monitor in order to confirm what they have heard and to enhance their recall,
particularly when dealing with testimony that involves a great deal of numbers.
Hearing-Impaired
Participants:
Realtime translation can permit hearing-impaired litigants and jurors to take part in the
proceedings in a new and more meaningful way. By providing the hearing-impaired individual
with a computer monitor, the realtime presentation permits enhanced participation in all
aspects of the proceedings.
Bench Conferences
Realtime permits second-chair lawyers, paralegals and the parties in civil and criminal
cases to be "present" at bench conferences by remaining at counsel tables and
reading the content of the sidebar conference on the computer monitor.
This can be of
particular benefit in a criminal case where the defendant has a constitutional right to be
present at all critical stages of the trial.
Objections:
In considering an objection, the Court has the benefit of referring to the precise
formulation of the question or statement before making a ruling. And while this may not be
of great significance in each instance, it is of enormous benefit when the content of a
lengthy question or statement is at issue.
In
the long run, it is clear that the use of realtime will enhance the quality of judicial rulings. |
