VIDEO DEPOSITION FACT SHEET
The followings
are standard procedures dictated by the
California Code of Civil Procedure. Any or all of these
procedures can be waived by stipulation.
Start of Deposition :
A brief statement is read into the record by the video
specialist. Each attorney will be asked to audibly identify
themselves and state whom they represent. The court
reporter swears in the witness and the examination begins.
Witness Screen-Space :
The witness is seen alone in a medium or head/shoulders
shot. Slight changes may be made to follow action.
Close-ups on Exhibits :
When requested, exhibits will be videotaped in close-up.
Off The Record:
The Video Specialist will go off the record only when all parties agree to do so. He /she will state, "Going off the
record the time is __;" turn off the equipment and say, "tape has stopped." At this point no recordings are made.
The Record:
After a break the Video Specialist will go back on the record
only when all parties agree to do so. He/she will state, "Going
back on the record the time is __;"
Changing Tapes:
To minimize interruptions, we strive to change tapes during
natural breaks. Occasionally we will ask for a short break to
change tapes.
Private Conversation :
Whispers and asides will probably be recorded.
Time/Date Stamp :
To help locate a specific portion of testimony, an
hour/minute/second stamp appears on the bottom of the
video screen and noted on the written transcript.
